These Terms & Conditions govern your use of the FAWDA platform and services operated by FAWDASTAR Agrisolutions Private Limited. By using the Platform, you agree to be bound by these terms.

Account Creation

Creating an account

To use our services, you must create an account (“Account”) on the Platform. To do so, you may need to provide certain information, including your mobile number. You must be at least 18 years of age to create an account.

Responsibility to provide accurate information

You represent and warrant that all details provided by you are correct, current, and truthful, and that they will continue to remain so.

Account security

Maintaining the security and confidentiality of your account is solely your responsibility. If your account information becomes known to anyone else, or if your account is used without authorisation, you must inform us immediately.

Responsibility for all activity on the account

You will be fully responsible for all activity on your account — whether carried out by you or by anyone else. FAWDA will not be liable for any unauthorised use.

Communications sent to you

You agree that FAWDA may send you the following types of communications and notifications:

  • Payment-related information
  • Updates related to our services
  • Promotional offers from us or from our partner organisations
  • Other essential service-related information

User Content (content shared by users)

Posting content

Our Platform may provide features where you can post, upload, or share comments, reviews, suggestions, feedback, photos, or other information (“User Content”).

Reviews and feedback

  • To maintain service quality, we may ask you for reviews about Service Providers.
  • Service Providers may also leave reviews about you.
  • You agree that any information you provide must not be false, misleading, or inaccurate.

If we believe you are not a suitable user for the Platform, we reserve the right to terminate your account.

Licence granted to FAWDA

By posting User Content, you grant FAWDA a non-exclusive, worldwide, perpetual, irrevocable, transferable, sub-licensable, and royalty-free licence under which FAWDA may:

  • Use, publish, display, store, host, process, modify, translate, distribute, and create new content based on the material.
  • Use the material in advertising, promotion, or as evidence in necessary legal proceedings.

Waiver of moral rights

You agree that you will not make any future claims for any “moral rights” or other similar rights in relation to User Content.

Right to remove objectionable content

If content posted by you violates these T&Cs, FAWDA reserves the right to remove or restrict it without prior notice.

Consent to use data

Data collection in accordance with the Privacy Policy

You agree that FAWDA may collect and use your personal information in accordance with its Privacy Policy. Our Privacy Policy is available on the Platform and explains, in detail, what information we collect from you and how we process it.

Sharing information with third parties

  • You agree that we may share your information with our trusted third-party service providers.
  • We may use your usage data to improve our services, perform analysis, identify trends, enhance the user experience, and develop new offers and plans.

Sharing data when legally required

Under applicable laws, if any government agency or law enforcement authority requests data, FAWDA reserves the right to share such data with the relevant authorities. You agree that in such circumstances we will be bound to do so.

Bookings

1. Placing an order

You can book Support Services on the Platform at any time, at your convenience. To make a booking, you must follow the instructions on the Platform and provide the required information.

We will make every effort to find an available Service Provider for your booking. If a Service Provider is not available for a particular time slot, FAWDA will not be responsible for providing one.

2. Booking confirmation

When you place a job request and a Service Provider accepts it, you will receive a confirmation via SMS or push notification. To confirm a booking, you must make payment in accordance with these T&Cs. The Service Provider’s contact details will be shared with you so you can discuss the job details directly with them.

3. Cancellation

If, for any reason, the discussion about the work is not successful, you must cancel the booking on the Platform itself. The amount paid will be fully refunded and your job request will be reopened.

Pricing, fees, and payment terms

1. Right to charge fees

FAWDA reserves the right to set and change fees for various services on the Platform, or for any additional features, from time to time.

2. Fees for Support Services

The amount displayed at the time of booking Support Services is the amount you will pay to FAWDA. This amount includes the Service Provider’s fee plus FAWDA’s fee. Responsibility for transferring payment to the Service Provider rests with FAWDA.

FAWDA will inform you of the applicable fees and available payment options at the time of booking. Generally, payment can be made via UPI. FAWDA may change payment options.

For clarity: the fees for Support Services belong to the Service Provider, and FAWDA, acting as a limited collection agent, collects this amount and transfers it to them.

All fees are inclusive of applicable taxes.

FAWDA may make reasonable changes to its fee at any time. However, the Service Provider’s job price is fixed by you at the time of creating the job order. Any change to FAWDA’s fee will not apply to bookings already confirmed before the change.

Fees charged after the completion of work are final and non-refundable, except where FAWDA decides to issue a refund in special circumstances or where required by law. If a Service Provider does not report for work, you will be entitled to a refund.

You acknowledge that fees may rise during periods of high demand in certain areas. You should consider the circumstances before placing a job order.

3. Payment Processor

We may use a third-party Payment Processor to process your payments. Their terms and conditions will apply in addition to these T&Cs. FAWDA will not be responsible for any error by the Payment Processor. If a payment fails, the amount will be refunded to you according to the Payment Processor’s policies.

4. Cancellation

You may cancel your booking without any cancellation fee before any Service Provider starts work.

5. Subscriptions

FAWDA may, from time to time, introduce paid subscription packages offering additional benefits such as discounted services. You agree that such subscription packages will be subject to additional terms and conditions, which will form part of these T&Cs.

Customer conduct

1. Discrimination of any kind is prohibited

FAWDA prohibits discrimination of any kind. Discrimination against Service Providers based on caste, religion, gender, age, nationality, disability, sexual orientation, marital status, or any other protected basis is strictly prohibited. Refusing bookings or showing discrimination in behaviour shall also be considered discrimination.

2. Respect and a safe workplace for Service Providers

You are expected to:

  • Treat the Service Provider with courtesy and respect.
  • Provide them with a safe, clean, and appropriate workspace.

If you fail to do so, or if your behaviour involves misconduct or rudeness, the Service Provider may refuse to work. In such cases, FAWDA reserves the right to restrict your account or limit the availability of services.

3. Your responsibility

If you:

  • Discriminate against the Service Provider,
  • Do not provide them a safe or clean workspace,
  • Conceal important information that may affect their safety or health,

the full responsibility shall rest with you. You must disclose all such important information to both FAWDA and the Service Provider.

4. Complaint about Service Provider misconduct

If any Service Provider behaves rudely, offensively, inappropriately, or contrary to law with you, you must report it within 48 hours to founders@fawda.in.

Third Party Services

Some services, content, documents, or information on the Platform may be provided by third parties that are not owned by FAWDA (“Third Party Services”). These may also include third-party websites or links.

You understand and accept that Third Party Services are entirely the responsibility of the third party that created or provided them. Use of such services is entirely at your own risk.

FAWDA makes no guarantee, promise, or assumption of liability regarding the accuracy, completeness, quality, or reliability of any Third Party Services. If you use any Third Party Service, you must also comply with the Terms & Conditions and Privacy Policy of that third party. All intellectual property rights associated with Third Party Services remain with the relevant third party.

Your responsibilities

1. Responsibility to provide accurate information

You undertake that any information you provide when using FAWDA’s services will be:

  • Complete
  • Correct
  • Accurate
  • And not misleading

If any of the information you provide changes, you are responsible for promptly informing FAWDA. FAWDA accepts no responsibility for any loss or issue caused by incorrect, incomplete, or misleading information provided by you.

2. Cooperation in legal matters

If any legal proceedings are initiated against FAWDA due to your breach of these T&Cs, you must fully cooperate with FAWDA.

3. Responsibility regarding User Content

You declare that:

  • All intellectual property rights in the User Content belong to you, or that you have obtained the necessary permissions.
  • All activities through your Platform account will be your responsibility.
  • Your User Content does not violate anyone’s rights, any agreement, or any law.
  • The User Content will not contain any virus, malware, harmful data, or files.
  • The User Content will not infringe the rights of any third party.

Your User Content must not be of any of the following kinds:

  • Infringing the rights of any individual
  • Against India’s unity, security, or sovereignty
  • Insulting to any other country
  • Defamatory, abusive, or hate-spreading
  • Obscene, pornographic, or harmful to children
  • Discriminatory on the basis of caste, religion, gender, or similar grounds
  • Encouraging violence or criminal activities
  • Illegal, unethical, or anti-social

Overall, your User Content must comply with the applicable rules, laws, and community values.

4. Proper use of services

You may use the services of the Platform only in the manner expressly permitted in these Terms & Conditions. You are not permitted to:

  • Violate anyone’s copyright, trademark, patent, etc.
  • Copy, share, modify, distribute, or publish the services without permission.
  • Send viruses, malware, spyware, or harmful code.
  • Use automated tools (such as robots or spiders) to scan or copy the Platform.
  • Collect information from the Platform to build a database.
  • Use the services for unlawful, fraudulent, or abusive activities.
  • Decompile, reverse-engineer, or disassemble the services.
  • Mirror, frame, or unlawfully link to the services.
  • In any way violate applicable law.

You also promise that you will not engage in any act that disrupts or impedes the services of the Platform.

5. Attempt at unauthorised access

You will not attempt to gain unauthorised access to the Platform, servers, or any associated networks. This includes hacking, password mining, or any other illegal method.

6. Attempt to remove Service Providers from the Platform or engage them privately

You may not, directly or indirectly:

  • Induce, entice, or influence a Service Provider to:
  • Leave the Platform,
  • Work with you privately,
  • Or bypass FAWDA.

This rule is necessary for the safety and confidentiality of Service Providers. You may still avail such services through other means, but you may not attempt to remove a FAWDA Service Provider from the Platform.

Our intellectual property

All intellectual property, rights, designs, and content related to the Platform and services are the property of FAWDA or its licensors. Subject to your compliance with these Terms & Conditions, FAWDA grants you a non-exclusive, non-transferable, non-sublicensable, revocable, limited licence to use the services. No other rights are granted to you beyond these.

Use of feedback

If you provide us with any suggestion, response, or bug report (“Feedback”), FAWDA may use it, copy it, publish it, distribute it, and use it commercially, without any obligation to pay you any royalty, seek permission, or give credit.

T&Cs and termination

1. Term of the T&Cs

These Terms & Conditions will remain in effect until terminated by you or by us.

2. Our right to terminate / suspend / discontinue

We may suspend or terminate your account or use of services, immediately or upon notice, if:

  • (A) You violate any provision of these T&Cs.
  • (B) You are no longer a user of our services.
  • (C) You are no longer eligible under law or FAWDA’s policies.
  • (D) You violate our Community Guidelines.

We may also discontinue services by providing 30 days’ prior written notice. We reserve the right to immediately terminate services for legal or business reasons.

3. Termination by user

You may withdraw from these T&Cs at any time by emailing us at founders@fawda.in.

4. What happens after termination

  • Your account will be closed.
  • Services will automatically time out.
  • Certain provisions (such as those relating to payment, disputes, and data use) will continue to apply after termination.

Disclaimers and warranties

1. Services on an “as available” basis

Our services are provided “as is”. We make no guarantees of any kind — express or implied — such as quality, fitness for a particular purpose, uninterrupted operation, or full satisfaction of your expectations.

2. No additional warranty from information

Any advice given to you in writing or orally does not create any new warranty.

3. Possibility of pricing errors

We make every effort to ensure prices are correct, but errors may occasionally occur due to technical or other reasons.

4. We are only a “connecting” Platform

FAWDA only connects you with the Service Provider. We are not responsible for:

  • Completing the booking,
  • Quality of the Service Provider’s service,
  • Any error, damage, or negligence on their part.

When you avail service from a Service Provider, your contract is directly with them — not with FAWDA. If you avail service from a Service Provider outside the Platform, that is entirely at your own risk and you may not raise any claim against FAWDA in such cases.

5. No guarantee of Service Provider quality / reliability

We do not guarantee the quality or suitability of any Service Provider.

6. User responsibilities

FAWDA is not responsible for any loss or consequence arising from:

  • Unavailability of services,
  • Technical issues,
  • Data theft or loss,
  • Server failure,
  • Loss of User Content.

7. Limitation of our liability

To the extent permitted by law:

  • Our maximum liability shall be limited to the commission we received on the relevant booking.
  • We will not be responsible for any indirect, special, punitive, financial, or emotional damages — such as loss of business or income, misuse of data, personal harm, or any other major or minor loss.

We do not exclude any warranties or liabilities that cannot legally be excluded.

Indemnity

You agree to keep FAWDA, and its employees, directors, and agents, safe from all kinds of claims, damages, third-party lawsuits, expenses, or legal fees, if any of the following situations arise:

  • You misuse the services.
  • You violate the T&Cs.
  • Any third party misuses your account.
  • Your fault or negligence causes any legal or financial harm to the company.

In such matters, you will also fully cooperate with us if any legal action is brought against us.

Jurisdiction, governing law and dispute resolution

These Terms & Conditions will be governed and enforced in accordance with the laws of India. Any matters arising from these T&Cs or the use of the services will be heard only by the courts at Saharanpur.

Dispute resolution (arbitration)

If any dispute, disagreement, or conflict arises from these T&Cs, it will be resolved through arbitration in Saharanpur.

  • The arbitration will be conducted in accordance with the rules of the Arbitration and Conciliation Act, 1996.
  • The matter will be conducted by one (1) independent Arbitrator, to be appointed by FAWDA.
  • The language of the arbitration will be English.
  • Both parties will keep the arbitration proceedings and information confidential, unless legally required otherwise.
  • The decision of the arbitrator shall be final and binding on all parties.
  • Each party participating in the dispute resolution shall bear its own costs.

Miscellaneous provisions

1. Changes to T&Cs

  • We may change these T&Cs at any time.
  • Changes become effective as soon as they are posted on the Platform.
  • Continuing to use the Platform means you accept the updated terms.

2. Modifications to services

We may add, change, suspend, or permanently discontinue the services at any time. We will not be liable for any loss arising from such changes.

3. Severability

If any portion of these T&Cs is declared illegal or invalid by a court, all other terms will remain in effect. If removing a small portion of a clause can make it valid, it will be removed.

4. Assignment of rights

You may not transfer your account, or the rights and responsibilities granted under these T&Cs, to anyone else without our written permission. We may grant or refuse permission at our discretion.

5. Notices

For any official notice, request, or correspondence under these T&Cs, our official email is founders@fawda.in.

6. Third-party rights

No portion of these T&Cs grants any rights to any third party.

7. Force majeure

We will not be responsible in circumstances where, due to reasons beyond our control, there is a delay or interruption in our services, such as:

  • Natural disasters,
  • War or riots,
  • Power, internet, or telecom failures,
  • Government orders or restrictions,
  • Strikes, fires, accidents, etc.

In such circumstances, delays in service will not be considered our fault.
